The ruling Pakistan Tehreek-e-Insaf (PTI) filed a fresh review petition against verdict in Faizabad sit-in on Wednesday in which the party discarded objections against Justice Qazi Faez Isa and said that they were not given a fair chance to present their case.
In an earlier review petition, the PTI accused Justice Qazi Faez Isa, the author judge, of being 'biased' and threatened that the judgment is sufficient to invite the verdict of 'professional misconduct' against Justice Isa in light of Article 209 of the Constitution.
Sources confirmed that the PTI's earlier review petition was returned after disapproval from the registrar office. Later, the Election Commission of Pakistan abolished the objections and resubmitted the plea.
Interestingly, none of the PTI leaders, now in federal cabinet, owned the review petition in order to avoid tense environment.
SC's official on the condition of anonymity said that Justice Isa is summoning files of review petitions to his chambers. The PTI's earlier review petition had contended that Justice Isa had admittedly made scathing comments on morality, politics and religion despite unambiguously and explicitly stating the limits of Article 184(3).
"Knowing well that aspects of morality, politics or religion fall outside the limits of the judicial power and jurisdiction of the superior courts, the impugned judgment has rather taken the pains to delve into such aspects," the review petition stated.
The earlier petition filed by Secretary PTI Arshad Dad prayed for entire review of the judgment on Faizabad Sit-in. Currently, more than 5 review petitions including from MQM, Ijazul Haq, PEMRA, IB and Ministry of Defence are filed against the verdict.
After withdrawing review petition, PTI through Barrister Ali Zafar re-filed a 5-page petition and prayed to only expunge remarks against the party in the judgement.
