
PESHAWAR: The Peshawar High Court’s (PHC) Bannu Registry granted bail to incarcerated members of the National Assembly (MNAs) and leaders of Pashtun Tahaffuz Movement (PTM) Ali Wazir and Mohsin Dawar on Thursday, but the move has not come without ‘preconditions’.
Both were arrested in May this year after a clash between protestors and military personnel in Khar Qamar tehsil of Data Khel in North Waziristan. They were accused of motivating the public to carry out an attack on the security check post.
The PHC placed certain preconditions on the two MNAs before granting them bail, a move that has received severe criticism from different quarters and on social media.
Ex-Senator Farhatullah Babar shared a tweet to condemn the move, saying “Conditions attached to bail granted to MNAs Ali Wazir & Mohsin Dawar highly disappointing.”
He said, “Bail conditions should be challenged legally.”
Meanwhile, journalist Sabih Ul Hussnain said in a tweet, “PTM leaders and MNAs Mohsin Dawar & Ali Wazir have not been granted bail permanently by PHC Bench.”
It read that, “PHC ruled that the bail is conditional, for a month, & subject to the condition of their good behavior. Both will have to get character certificates from DPO every week.”
The move has been termed extra-constitutional by experts who have been calling for it to be challenged in courts.
It is important to mention here that Mohsin Dawar is MNA from NA-48, while Ali Wazir is from NA-50 of North Waziristan. Both contested as independent candidates during the July 25, 2018, general elections.
