Lawyer and former senator Aitzaz Ahsan has said that the Supreme Court had no right to interfere in the extension of the chief of army staff.
While talking to media, the PPP leader said that appointing the army chief was the right of the prime minister and the judiciary cannot interfere in the matter.
He added that the principle of parliamentary sovereignty was (to be held) supreme.
The lawyer said that deciding whether the prime minister had made the right decision was not the responsibility of the judiciary. He added that the prime minister had the right to make the decision and recommend who would be the army chief to the president.
Ahsan further said that according to article 243, the president can only appoint that person as the army chief, who had been recommended by the prime minister.
Regarding a question of whether the extension was justified, he responded that if the extension was to be challenged, questions could be raised on the qualification of the army chief, but not on the decision of the prime minister.
The Supreme Court on Tuesday had suspended the notification of extension in services of COAS General Qamar Javed Bajwa. The COAS and other parties had also been issued notices by the apex court.
