Zulfikar Ali Bhutto’s case is considered one of the blackest of black decisions made by our judiciary. He was sentenced by an 8-member bench. One of the judges, Justice Waheedudin Ahmed, was critically ill and therefore the judgment was a 4-3 split decision, with 3 judges acquitting Bhutto and 4 holding him guilty. Justice Durab Patel, who had written the dissenting judgment, in this rarely seen interview explains why he had acquitted Bhutto in his verdict and expresses his disappointment over the judges’ refusal to convert the sentence into life imprisonment despite a clear split among the judges.
