Marvi Sirmed says that successive governments have tried to assert the Executive’s authority over the Legislature throughout Pakistan’s history. She says that the only government that didn’t take this path was PPP’s from 2008 to 2013, although the founder of Pakistan People’s Party Zulfikar Ali Bhutto’s tenure was no different from the other ones.

Recently, government representatives were reported to have said that they were mulling changing the laws on the right of the elected representatives to production orders. Marvi says that there’s no way for the government to change the law through the parliament because they simply don’t have the numbers to do that.

However, Prime Minister Imran Khan had stated that the government would do it through a presidential ordinance. Marvi says that it was impossible for the government to overrule an act of the parliament through a presidential order.

She said that the right to the issuance of production orders was given to the parliamentarians through legislation in 2007, and, therefore, if the presidential ordinance is issued in order to overrule the law, it would actually be in violation of the law.
